Why You Should Attend

The "DieselGate" Volkswagen Emissions Scandal marked the fourth distinct nationwide and international auto-defect crisis for international manufacturers. That case has been followed by a similar action against Mercedes, as well as class action cases against Fiat Chrysler relating to its Jeep shifter assembly and BMW regarding its i3 electric vehicle. Starting with the Toyota Sudden Unintended Acceleration Litigation, the world of auto-defect class actions has blossomed and transformed.

Auto-defect mega-cases frequently include violations of various consumer fraud and deceptive practices statutes, common law fraud, fraudulent concealment, and breach of contract claims. State and federal warranty and lemon laws may also be implicated, and case management may be complicated by the existence of multiple state, federal, and international parallel government investigations.

Much of the publicly available information about automobile defect class action suits comes from sources that are unfamiliar with the mechanics of class action litigation, that do not know much about product engineering in the automobile industry, and that have little experience dealing with the special issues that arise in the context of investigations and litigations that involve global business titans.

Hagens Berman and Lieff Cabraser have worked together in most of the recent auto-defect mega-cases. Hagens Berman also led the Hyundai/Kia MPG litigation, and is leading the Volkswagen Dealer case, the Mercedes Diesel case and the BMW i3 litigation. Leiff Cabraser has a leadership role in the Takata airbag litigation.

Our objective for this program was to assemble leading class action practitioners from both the plaintiff and defense sides with deep experience with the automobile industry to address the unique issues and provide practical insights. We hope to see you there.

Thomas E. Loeser Thomas E. Loeser , Program Co-Chair, is a Partner at Hagens Berman Sobol Shapiro, LLP. His practice focuses on automobile defect litigation, class actions, False Claims Act and other whistleblower cases, consumer protection and data breach/identity-theft/privacy cases. Previously, he was a federal prosecutor at the United States Attorneys Office in Los Angeles, where he was a member of the Computer and Intellectual Property Crimes Section.

David S. Stellings David S. Stellings , Program Co-Chair, is a partner at Lieff Cabraser Heimann & Bernstein LLP focusing on complex consumer fraud cases. His firm currently serves as lead counsel in the VW Clean Diesel consumer litigation.

Bruce A. Abbott Bruce A. Abbott is a litigation partner in the Los Angeles office of Munger Tolles & Olson LLP. Although primarily a defense lawyer, Mr. Abbott often serves as a plaintiff's lawyer in high-technology and other complex business disputes. He previously served as a special prosecutor focusing on major fraud investigations, indictments and criminal prosecutions.

Jonathan I. Arnold, Ph.D. Jonathan I. Arnold, Ph.D. is a Senior Consultant for Compass LexEcon. He is a testifying expert specializing in loss causation and economic damages. His experience includes service as Chief Economist for the New York State Attorney General where he worked at integrating economic analysis with legal analysis.

Benjamin L. Bailey Benjamin L. Bailey is a founding partner of Bailey & Glasser LLP. He is currently serving on the Plaintiffs' Steering Committee for the Volkswagen Diesel Emissions MDL pending in the Northern District of California. He also served on the Plaintiffs' Lead Counsel Committee for the Economic Loss Cases in the Toyota Sudden Acceleration MDL in the Middle District of California, which settled for $1.6 billion.

Gretchen Freeman Cappio Gretchen Freeman Cappio is a partner in Keller Rohrback LLP's Complex Litigation Group focusing on class action cases. The cutting-edge and complex matters she has litigated include advocating on behalf of Volkswagen, Audi, and Porsche consumers in In re Volkswagen "Clean Diesel" Marketing, Sales Practices, and Products Liability Litigation.

Daniel Carder Daniel Carder , director of the WVU Center for Alternative Fuels, Engines and Emissions, led the research team that discovered elevated emissions from Volkswagen diesel vehicles and sparked further investigations by regulators.

Christopher R. Carroll Christopher R. Carroll is a partner at Carroll McNulty & Kull. He focuses on insurance coverage disputes, including those involving products liability in the automobile industry.

Robert A. Clifford Robert A. Clifford is the founder of Clifford Law Offices, which concentrates on helping plaintiffs in cases including consumer fraud and defective products. His automobile class action experience includes the Volkswagen "Clean Diesel"

Kevin R. Dean Kevin R. Dean is a member at Motley Rice LLC where he represents people allegedly harmed by defective products. This includes numerous vehicle defect cases, including "the Big Three" automotive manufacturers in cases involving defective brakes, door locks, door latches, seat belts and rollovers. Currently, he is involved with litigation over Takata airbags and In re General Motors LLC Ignition Switch Litigation.

Robert C. Hilliard Robert C. Hilliard is a partner at Hilliard Munoz Gonzales LLP where he focuses on mass torts and product liability. He was appointed co-lead counsel in the National GM Ignition Switch Litigation. This multi-district litigation is considered the single largest product liability litigation in US history.

Derek W. Loeser Derek W. Loeser is a senior member of Keller Rohrback's nationally recognized Complex Litigation Group. Many of Mr. Loeser's cases have required coordination with state and federal agencies involved in litigation that parallels cases pursued by Keller Rohrback. Previously, he was a trial attorney for United States Department of Justice where he prosecuted class action employment discrimination cases.

Matthew H. Marmolejo Matthew H. Marmolejo is a litigation & dispute resolution partner at Mayer Brown LLP. He regularly represents automobile manufacturers in a variety of litigation and regulatory contexts including motor vehicle safety matters, including NHTSA proceedings involving compliance with the National Traffic and Motor Vehicle Safety Act and the Transportation Recall Enhancement, Accountability and Documentation (TREAD) Act.

Mark S. Mester is a partner at Latham & Watkins LLP where he served for five years as Global Chair of the firm's Consumer Class Action Practice Group. His clients include the American Automobile Association, American Honda Motor Co., Inc., Navistar, Inc., and Mitsubishi Motors North America, Inc.

Curtis B. Miner Curtis B. Miner is a partner at Colson Hicks Eidson where he represents businesses and individuals in matters ranging from governmental and internal investigations to securities and financial frauds. Previously, he spent five years as an Assistant United States Attorney in the Southern District of Florida in the Major Crimes, National Security and Public Corruption Sections.

Sharon L. Nelles Sharon L. Nelles is a partner in Sullivan & Cromwell LLP's Litigation Group. She represents global companies in high profile, critical company matters that implicate not only civil litigation but also related regulatory, congressional and criminal investigations and enforcement actions.

Peter Prieto Peter Prieto , Podhurst Orseck PA, focuses on complex commercial litigation, including class actions. He currently serves as Plaintiffs' Chair Lead Counsel overseeing both class actions and personal injury actions in In re: Takata Airbags Product Liability Litigation. He also serves on the Plaintiffs' Executive Committee in In Re: General Motors LLC Ignition Switch Litigation.
