Why Order

Complex cases pose quite a challenge from a case management standpoint because they involve vast amounts of documents, numerous witnesses and, typically, complicated legal and factual issues. Properly managing a complex case requires careful planning, adept use of technology, and, most importantly, a highly-organized and highly-functional case team. This course will provide easy to apply methods to manage a complex case from the initial filing through trial. The course will emphasize: (1) setting up the essential case work product for maximum use; (2) case planning methods for staffing, discovery plans, litigation budgets and risk assessments; (3) managing the team during both pretrial and trial; and (4) maximizing the use of technology to effectively, efficiently and persuasively manage and, ultimately, present the complex case. Additionally, top experts in their fields will discuss the best practices for managing large document collections and production, how to simplify the complex case into a compelling story that a jury will understand and embrace, and how to maximize the presentation of the complex case in the resolution venue, e.g., trial, arbitration, mediation. Continuing Education Credits

Law Seminars International is a State Bar of California approved MCLE provider. This program qualifies for 6.5 California MCLE credits. Upon request, we will apply for CLE credits in other states and other types of credits.

Cost

Our complete Homestudy Course, consisting of a VHS or DVD recording and the written course materials, is available for $605. The written course materials alone are available for $100. Faculty Bios

David H. Dolkas is a partner in the Silicon Valley office of McDermott Will & Emery. He specializes in complex IP and commercial litigation. For over a decade, Mr. Dolkas has taught lawyers across the country methodologies for managing complex litigation, with an emphasis on maximizing the use of technology. He has presented his approach and methods in presentations to the State Bar of California (annual meeting), American Intellectual Property Lawyers Association, Defense Research Institute, United States Department of Justice and numerous bar associations. Mr. Dolkas is also an adjunct professor of law at the University of Santa Clara Law School, where he teaches a class entitled Managing Complex IP Litigation. Mr. Dolkas was recently recognized as one of Northern California's Top 100 intellectual property litigation attorneys, according to "Super Lawyers," San Francisco Magazine.

Kevin M. Hout P.E., President of Fulcrum Legal Graphics, leads and manages the development of graphics, videos, computer animations, and multimedia presentations used to explain complex technical and legal issues in court of law. He has testified in court regarding the accuracy and admissibility of highly technical computer simulations and animations. Mr. Hout lectures as an expert in high tech demonstrative evidence to such groups as the American Bar Association, Defense Research Institute, American Inns of Court, Association of Business Trial Lawyers, Construction Superconference, American Board of Trial Advocates, Association of Defense Counsel and many others.

Richard T. McCollum, Senior Consultant at JurySync, has nationwide experience involving all phases of jury research in state and federal civil cases. He has designed and implemented research programs in litigation involving federal antitrust claims between Fortune 500 corporations, securities fraud, intellectual property, national pharmaceutical product liability, blood supply contamination and medical malpractice. As a member of the JurySync team he is frequently asked to advise clients on specialized areas of juror decision-making and theory development in highly technical commercial and tort litigation. In addition to pretrial research programs, his practice includes jury selection support, witness preparation, trial support and litigation related public communication strategies. Mr. McCollum received his advanced education in the specialized Legal Communication program at the University of Kansas. His academic research focused on jury decision-making, attorney rhetorical tactics and the relationship between public relations efforts and persuasion in the courtroom. He taught university courses in argumentation, business communication and rhetorical theory.

Dave Swider is Director of Special Projects for Syngence. In addition, he's a Certified Concordance Trainer and an Accredited iConect Administrator. Mr. Swider has served as a Regional Manager, Sales Engineer and Director of Sales Engineering since coming to Syngence in 2002. His responsibilities have included project management, client training and working with firms to implement strategies for searching and working through discovery document collections. Mr. Swider's previous experience includes serving as Director of Digital Services for California-based Applied Solutions, Inc., General Manager, Document Management Services, and Facilities Manager, Pitney Bowes Management Services, both based in Boston.
