"Congress enacted the Clean Water Act more than 30 years ago, yet the Act remains a work in progress. Last year, the Washington Department of Ecology adopted revised water quality standards. Those standards are being reviewed by the Environmental Protection Agency and agencies enforcing the Endangered Species Act. Ecology also has issued new general stormwater permits which have been challenged and are likely to be revised. These and other evolving Clean Water Act developments affect businesses, governments, and the public as well as the environment. Faculty Bios

Michael O’Connell, program co-chair, practices in the firm’s Environmental, Land Use and Natural Resources practice group on matters relating to large project permitting, including environmental and natural resources law, wetlands, threatened and endangered species, water rights, water quality and Indian law.

James Tupper, program co-chair, of the Mentor Law Group has eighteen years experience representing clients on complex land use and environmental permitting matters involving shoreline development, water quality certifications, NPDES permits and stormwater regulation. He served two terms on the Washington State Pollution Control Hearings Board and Shoreline Hearings Board.

Jerry W. Alb, an Independent Consultant presenting on behalf of the Associated General Contractors of Washington (AGC), is retired after working with the Department of Ecology, Fish & Wildlife and Transportation over the past 14 years. One of his past positions includes Director of Environmental Services for the Washington State Department of Transportation.

Gary C. Bailey is Vice President of Innovative Design, Inc. and Principal of partner firm, Solargenix Energy, previously Duke Solar. Duke Solar and Innovative Design have combined advanced solar technology and sustainable architecture to produce a unique building-integrated solar thermal solution, the Power Rooftm, systems that are now being implemented in offices and industrial buildings throughout the world.

Martin Baker, Strategic Advisor in the Director's Office of Seattle Public Utilities, is responsible for the environmental performance of the utilities system including ESA and sediment clean up. He also assists the Director in managing cross department and policy teams, He previously was the assistant director of the Habitat program for the Department of Fish and Wildlife.

Adam Berger of Schroeter Goldmark & Bender focuses his practice on consumer protection, environmental law and serious personal injury as a result of environmental contamination. Prior to joining the firm, he served more than eight years with the Earthjustice Legal Defense Fund representing individual and institutional clients in the Pacific Northwest.

Luanne Coachman has been with the King Co Water & Land Resources Division since 1991. Over the past six years her work has been devoted primarily to SEPA appeals and the remaining focused primarily on the Cleanwater Act. She is also responsible for coordinating King County’s NPDES municipal storm water permit compliance.

Richard Du Bey, a partner at Short Cressman & Burgess PLLC, is Chair of the Environmental and Natural Resources Section and focuses his practice in the areas of environmental, land use, natural resources, energy, federal, administrative and Tribal law.

Kristine Holm founded Water Resources Northwest after many years as an environmental consultant and planner and later as an attorney specializing in water related issues. She was long time Chair of the Association of the Washington Business Water Quality Committee, and represented the Northwest Paper & Pulp Association for nine years.

Kim Maree Johannessen is founder of Johannessen & Associates, PS. Her experience includes regulatory compliance, permit appeals, defense of citizen suits and enforcement actions.

Matthew A. Love of Van Ness Feldman, P.C. focuses his practice in the areas of the Endangered Species Act, hydroelectric, land & water, litigation and Native American. Prior to joining Van Ness Feldman, Mr. Love worked for the Federal and the Washington State Governments as a natural resources litigator.

Bill Moore is supervisor of the Stormwater Unit at the Department of Ecology which is responsible for the development of the Departments phase I and phase II municipal stormwater permits, the industrial and construction stormwater general permits, and the Stormwater Technical Manuals for Eastern and Western Washington.

Jerry Ninteman, Environmental Engineering Department Manager of Landau Associates, Inc., has been an environmental consultant for 19 years managing numerous projects involving soil and ground water remediation and stormwater management. He is currently managing industrial stormwater permit requirements at a multi-tenant regional airport in Snohomish County.

Katrina "Kate" C. Pflaumer, Attorney at Law, is the Chair of the Legal Committee for the Puget Sound Soundkeepers Alliance. She is also a consultant and limited practice attorney working as an auditor with the Seattle Police Department. She previously was a U.S. Attorney for eight years under the Clinton Administration.

Christine Psyk has been with the Environmental Protection Agency for 13 years and is currently Manager of the Watershed Restoration Unit in the Office of Water.

Susan M. Ridgley is Port Counsel for the Port of Seattle, where she specializes in environmental and land use law. She advises both marine and aviation clients in the areas of air quality, shoreline management, ESA, storm and surface water permit requirements, and federal and state hazardous substance management and cleanup laws.

Richard A. Smith, a member at Smith & Lowney, PLLC, represents environmental and community groups in litigation involving pollution and natural resource issues. He has also represented plaintiffs in numerous Clean Water Act citizen enforcement actions.

Kenneth Taylor, president of KTA Associates, Inc., has more than 17 years of experience successfully managing environmental programs. His clients include those in the private as well as publc sector. He is a recognized expert with the development and implementation of Environmental Management Systems (including ISO 14001 systems). He also has extensive knowledge regarding the evaluation of management decisions and associated risks.

Theresa R. Wagner is a Senior Assistant City Attorney with the Environmental Protection Section of the Seattle City Attorney's Office, and represents the City in the areas of environmental compliance and enforcement, environmental contracting and litigation, and health and safety compliance.

David P. Wilson is a Senior Aquatic Scientist with CH2M Hill. With over 25 years experience with water quality, he specializes in the analysis of aquatic impacts and the development and implementation of strategies and solutions relating to water and sediment quality issues. His specialty is NPDES permit negotiation and compliance issues.
