The Internet is alive with newly-invented businesses marketing their goods and services as well as traditional "bricks and mortar" businesses making the transition to the Internet marketplace. This raises a host of new legal issues. The Internet is inherently global and it is difficult to limit an offer or promotion to consumers in a specific geographical area. Successful businesses in the digital economy will be the ones able to understand the constraints of e-commerce and devise effective marketing campaigns within the tighter constraints of a global marketplace.

Intellectual Property has a pervasive presence on the Internet. Successful Online commerce requires new processes and the most successful new processes may be protected by some companies as Intellectual Property. E-commerce has also created new approaches to marketing including the ability to "personalize" marketing through sophisticated use of data about individual customers. Privacy concerns continue to be a sensitive legal issue and must be considered when counseling Online marketers. Some new processes are patentable, and there has been a proliferation of business patent applications.
