Why You Should Call In

How do you determine and then prove how much environmental contamination affects the value of real property? That question comes up in the course of transactions, in insurance disputes, when accounting, in litigation over transactions and indemnifications, in property tax disputes, and countless other scenarios. While it appears straightforward, it can be a surprisingly complicated question.

For example, should you just deduct the cost of cleanup from the value of the property "clean?" If so, how do you determine "clean" value of property with a long industrial history? What technical and legal questions come into play when estimating cleanup costs? Finally, who should pay when cleanup estimates turn out to be wrong?

David G. Mandelbaum, Moderator, is partner at Greenberg Traurig LLP and is Co-Chair of the firm's Environmental Practice. Mr. Mandelbaum represents clients faced with problems under the environmental laws that have no conventional solution, or for which the conventional solution would yield an unacceptable result. While he regularly represents clients in lawsuits, he does not restrict his practice to litigation and has helped clients achieve satisfactory outcomes through regulatory negotiation or private transactions.

James A. Bruen, is partner in Farella Braun + Martel LLP's Environmental Law Department and Product Law Department. Mr. Bruen's practice includes representation of industry, universities and governmental institutions in complex domestic and international products and environmental counseling and litigation. He is also a highly regarded expert in product stewardship with wide-ranging experience in product design, manufacturing, distribution and stewardship issues, as well as on plant sitings, plant closures, raw material sourcing, EHS management systems, codes of conduct, effluent guidelines and other sustainable development issues.

J. Chris Herin, P.G., principal hydrogeologist, is a leading practitioner in the field of environmental risk management and minimization where he focuses on the mitigation of environmentally impaired properties, environmental compliance, due diligence (All Appropriate Inquiry), and cost-to-cure estimates. He also specializes in groundwater studies, contaminant fate and transport evaluations, and waste management. He is often tapped to serve as a technical expert in litigation on these issues.
